The Court adjourned until 11 a. m. Thurs- day. In charging the Jury, the Chief Justice stated that the case had taken up the attention of the Court for seven days. A great deal of evidence had been heard from both the plaintiff and the two de- fendants, some o1 it of much im- portance and some oi no conse- quence whatever. This action was brought against the two defend- ants who were not_ only defending themselves against the plaintifl a- lone but against each other. The plaintiff says that he is a carpenter, defendant Acorn is an owner of a taxi business and de- fendant MacDonald a Hotel Keep- er and contractor. The plaintiff says that on December 21st. 1028. he went to Acorn to get a car to convey him to the Railway Stat- ion. The Court pointed out at this stage that, the plaintiff did not see Mr. Aoom at all. The plaintiff went there in the morning and saw somebody who was in Acorn‘: em- ploy and who was attending to the office at that time; yet the Master is responsible for the action of his servants, so when he engaged a servant of Mr. Acorn‘s he engag- ed Mr. Acorn.
