tue case of the Whitewayites is almost exactly parallel with that of the Govern- ment party in this Province. It will be remembered that Sir William Whiteaway was sustained in the elections of November last by twenty-four to twelve. The result was, like thatof the P. E. Island elections in December, “a great surprise to both parties.” The well informed correspond ent of the Montreal Gazette reports that

“The Opposition accounted for their crushing Ccefeat by alleging that the Government had used foul means to se- cure the return of many of their party, and had been guilty of bribery and cor- ruption on an extensive scale, by expend ing large sums of public money on roads and other public works, for the most part in a wasteful and eatravagant manner, just before polling day, eo as to distribute im- mense amounts in the payment of wages among thousands of laborers, thus in- fluencing their votes. Notfonly, they de clared, had the public funds been thus wasted, but an illegal use had been made of them to corrupt the constituencies and secure votes in flagrant violation of the act bearing on corrupt practices at elections, and to the injury of the rights and privi- leges of the candidates opposed to them. These allegations were followed by peti- tions against the return of no less than

| seventeen members of the Whiteway party } from nine different electoral districts. In

this list were included the Premier, colo- nial secretary, the surveyor-general, re- ceiver-Genera! and the Hon. E. P. Morris, another member of the executive.

The first petition tried was that against the return of the Hon. H. B. Woods, sur- veyor-general, and Mr. Moores, his col- league, who were sitting members for the district of Bay de Verde. Sir James Win-

ter was the judge in this case. tense in- terest was awakened. The cad for the

petitioners occupied fifteen days, and about fifty-five witnesses were examined. The defence and the closing addresses of coun- sel on both sides, together with a length- eved argument on some important law points which had heen raised, occupied nearly a fortnight. At length on the 27th of March, judgment was delivered by Sir James Winter.

There is but one op‘nion as to the emi- nent I gil ability disclosed im this judg- ment, which is destined to be memorable ia the history of the colony. Sir James’s decision was that the charges against the re pondents, as to giving employment in Bay de Verde to large numbers of men in order to indnce them: to vote, are sus- tained against the respondents; that the charge against the respondent Woods of giving employment to the voters of the dis- trict of Bay de Verde in the city of St. John’s, with the object of inducing them to vote, is also sustained; that three cases of personal br.bery, by giving small sums of money to two individuals, and procur- ing a situation in the Custom House for another in return for canvassing were also sustained; that the charge of sending home, by railway, voters from St. John’s, was bribery avd an illegal practice and was fully sustained, the agency in this matter of the Hon. Mr. Morris being established, but without the knowledge of the respon- dent. On these grounds Sir James held that respondents are guilty of corrupt practices by themselves and by ther agents, both with and without their knowledge; aad that the election is void.

“Jn the course of his judgment Sir James pointed out that Mr. Woods, who had been returned a member for the dis- trict in 1889, had promised the people u road, which promise had not been ful- filled, and now that he was a candidate for re-election in 1893, he took measures to have this road constructed in order to secure his election, and he made it a con- dition with the Executive that he should be put ina position to fulfil his former promise. Just before the close of the session of 1893 a loan ot $100,000 was authorized by the legislature for the pur pose of building roads to connect various districts with the new line of railway. Out of this loan Mr. Woods obtained some $6,000 for the purpose of building his promised road, and on the eve of the elec- tion he, on his own authority, allocated this and other grants, and placed a large number of men on public worke. The judge held that this was a misappropria- tion of the loan in question, as the roads on which it was used did not eome_ with- in the object of the act, and were not de- signed to connect with the railway, and could not possibly do so. He also held that the executive had no _ legisiative authority for using the loan in this way. By appropriating it as he did, Mr. Woods used it for electioneering purposes. He held that giving employment and carry- ing out work on the eve of an election, where the object evidently was to obtain votes, constitutes bribery under the Cor- rupt Practices Act. It was no mitigation of the offence that public money was used on public works. The giving ofa promise was not less a bribe because it is in connection with carring out a public work. “Throughout the entire district of Bay de Verde,” said the judge, “during the last election, one subject occupied the attention and governed the action of the people—that was Government money

chiefly road money. ‘ We'll vote for the man that gives us the work,’ etc. This was the subject of most of the evidence of the witnesses. The only politics they knew or cared for was road work. By that, and that alone, their vote was deter- mined, and there was no reason to doubt their evidence. The candidate (Mr. Woods) was in a position to bring iato the canvass Government money, as it was called, to arm himself for the contest. Mr. Woods’s own address, on nomination day, proved that the work given by him to voters of the district in St. John’s, and the money he had received for roads in the district, were intended to influence the people’s votes in his favor, and evidence showed that it had done so. There was no pressing necessity for having the werk done last fall, and therefore the presump- tion was that it was given with the view of influencing the electorate.” Such was, in substance, the utterance of the judge on these points. As the evidence was clear and conclusive, especially Mr. Woods’ own testimony, the judge had no alterna- tive but to find that the charges were sus- tained and the penalties were fixed by the act—namely loss of seats and disqualifi- cation.

It will have been remarked that their methods were in some respects similar to those of the gritsof this Province. A point of difference to be noted is that while the Whitewayites diverted legitimate grants tu iNegitimate election expenditures on roads, ete, our grits borrowed money from the banks to carry on works which the Legis- lature had not authorized. The public accounts of this Province show that last year’s estimated expenditures on roads, bridges, ferries and wharves, and miscel- laneous, werefor $61,248.00, the actual expenditures to $107,632.36—an excess of $46,384 36. IMPORTANCE OF MARRIAGE.

Tue Westminster Review for April con- tains an article by Lady Cook (nee Ten- nessee Claflin) upon the important and ever-interesting subject of marriage. The article is entitled “A Short History of Marriage,” and contains much that is

repugnant to those who are vcontert with the standards which have been reachel under our Christian

civilization. It is, however, exceedingly well written, and, upon the whole, decid- edly more interesting than edifying. As bearing upom a question which has lately been discussed here, we quote the follow- ing:

“Tt can easily be proved, however, that all the social and moral virtues have arisen from the eircumstances attending the right of family and individual pro- perty; and that, therefore, any attempts to- ward+ destroying these valuable incentives to personal exertion and national energy would be so many fatal steps backwards towards barbarism and universal immora)- ity. Honour, chastity, modesty, fidelity, in their first feesle birthdate from the time when the right to individual property made its appearnce, and when this oceur- red barbarism was already far in the rear”

As to the reasons for marriage, Lady Cook says:

“But we regard love as all-sufficient in itself, and the true touchstone by which ae may be proved. And by love we mean that intelligent and mutual respect and sympathy, that unity cf thought and aim, that blending of two in one which makes each reacy for any sacrifice, or even to die for the other—a union which neither time nor accident can destroy. This alone is marriage, and is able to transtorm the peasant’s cotand patch into a veritable paradise, while without it a palace may be hell, We have heard of men, rough, com- monplace beings, who could brave Arctic or Torrid wastes in severest cold or heat, in hunger and thirst, so long as they were cheered by the companionship of their fel- lows. Our first real hunger is heart hun- ger. Prisoners denied human companion- ship have sought comfort in the affection of a bird, a mouse, or even a spider. All true natures must have some one or some- thing to love. And although the love of of youth is charming and picturesque, the love of old age is radiant with beauty. To see two human creatures who have weath- ered together in closest communion all the storms and ills of life, battered and deform- ed by time, yet able tolook into each other’s eyes with a love surpassing that of

their first affection, is a sight grander than any other the world can show. For it re- veals tous the depth aud purity of mar- riage as it should be.”

In conclusion, Lady Cook condemns care'ess selection of husbands and wives without rez J to ancestral and personal purity, health and strength, physical and intellectual, and says:

“Wecommend onr readers to search further for themselves. Possibly the day is not-far distant when education wil] be

directed on better lines, when the teaching of physiology will be compulsory, and soundness of mind and body will be the chief desiderata. And when sex distinctions and privileges are swept away, physical, moral and mental improvements wil] grow apace. This beautiful world will be the home of beanty. Ignorance and crime, like unclean beaste, will flee to its remote recesses, Men will live for themselves and for each other, and not for arbitrary laws that harass, injure, and destroy. The foul brood engendered by ages of superstition will disappear, and all will see that only through a new and wiser system of mar- riage can the regeneration and perfection of mankind be brought about.”
