N the matter of. an application for eXecution to be

issoed against the Lands of Horatio Nelson Hope, late of Township Number Seventeen, in Prince County, in Prince Edward island, Esquire, deceased. His Right. Title and Interest therein, under the provisions of the Act of the General Assembly of the said Island, passed in the Twenty-fourth year of the Reign of Her Majesty Queen Victoria, intituled. “An Act in amendment of and'addition to the Act relating to Judgments entered of Record in the Supreme Court of Judicature,” in a cause wherein Daniel Hodgson and Theophilus Des- Brisay. surviving Trustees and Executors of the last \Vill. and Testament of Benjamin De Saint Croix, de-v ceased, were l’laintitlz’s, and. the said Horatio Nelson Hope, was Defendant.

VVthreas, application hath been made to this Court. on the part of the above named Plaintiff’s. Daniel Hodgson and Thcophilns DesBrisay. survivmg Trustees and Execut‘ors as aloresaid,staﬁng that the sums of Two hundred Pounds debt, and Three Pounds costs, together with Twenty-two Peuuds, ﬁfteen shillings interest thereon, are due and owing to them on, and is secured by a. certain judgment entered of record at their suit against the said Horatio Nelson Hope, on or about Hilary Term, A. D. 1866. for the sum of Four hundred Pounds debt, and the said sum of Three Pounds, costs of suit, and execution on such judgment hath been moved for on behalfofthc Sald Daniel Hodgson and Theophilus DesBrisay, surviving Trustees and Executors, as afore— said.

' It is ordered that unless all or some of the persons interested in the lands formerly belonging to the said Horatio Nelson Hope, deceased. shall. on the first Tuesday in May, next, coming, at Charlottetown, come forward and show cause why execution should not be issued upon the aforesaid judgment as prayed for, then execution willbe issued'against the Land, Tenements, and herditaments of the said Horatio Nelson Hope, de- seased, in pursuance of the Act of‘the General Assembly of Prince Edward Island. passed in the Twenty-fourth year of the Reign of Her present Majesty, intituled, “ An Act in amendment of and in addition to the Act relating to judgmentsentered of Record in the Supreme Court ofjudicature.” r I
