Honorable the becretary of State for the Colonies to the Administrator of the Government, are published by desire of the Secretary of State. in order that all persons in this Colony engaged in trade with Cuba, may be made aware of the danger to which life and property may possibly be exposed under the Decree of General Dulce, the Governor of that Island, and against which Her Majesty’s Government have rcmo’nstrated :—

I have the honor to transmit herewith to your Lord- ship the printed copy of an extraordinM‘y and injudicious Edict, issued two days ago, by Gene al llulce, the Gov- ernor of this Islam], (accompanied by a translation) which Edict has caused much trouble and dismay among all engaged here in foreign commerce.

Trading vessels. loaded with ﬂour or other cargo which may be interpreted as “ supplies of food.” whilst beating to windward in the Bahamas or Florida Channels, may. in terms of the Edict, be captured and treated as Pirates.

The Decree speaks for itself, and requires no comment.

The better service of the. state. requiring it. and with the ﬁrm purpose that the Insurrection, already mastered by the force of arms in the interior, should not receive any aid from outside, which might contribute to pro- long it, to the serious prejudice of property. industry and commerce; in the exercise of the ext 'aort'linary and discretional powers with which I am invested by the Supreme Government of the Nation, I decree as fol- lows :—Vessels which may be captured in Spanish Waters or in the open seas bordering on the Island, with cargo of men, arms and ammunition. or articles which can. in any way, contribute to promote or encourage the insurrection in this province, whatever may be their place of departure, or their destination, and after ex- amination of their papers and register shall be consider- ed, “de facto.” as enemies of the integrity of our terri- tory and treated as Pirates according to the ordinances ,of the Navy.

Persons, in whatever number, found on board of such vessels shall be immediately shot.

General Rules.

1. It is ordered, that in future when appeals are dis- missed because no notice of appeal has been served. no costs shall be taxed unless the appellce or his Attorney shall make an afﬁdavit that the said appellce did actu— ally consult such Attorney respecting the case so ap- pealed, at least nine days before the commencement of the Court at which such appeal (if notice had been given) would have been tried—in which case, a fee not exceeding one guinea, with the cost of such afﬁdavit. and no more, shall be taxed for Attorney’s or Counsel's fees; provided that nothing in this rule shall extend to prevent ordinary costs being taxed in any appeal dis- missed, on hearing, in consequence of the notice being defectiVe.

2. That in all so dismissed for want of notice the Prothonotary shall, On request of the appellee. and on payment of his fees, issue execution for the amount of the Judgment and costs awarded to such appellee in the Court below, together with the costs of such execu- tion, without the intervention of an Attorney; pro- vided that in cases where such appellee shall employ an Attorney to procure such eXeeution, a fee of six shil- lings and eight-pence, and no more. shall be allowed such Attorney. and which the Prothonotary shall, in such case. add to the amount to be levied in such exe- cution without a Judge‘s allocutor therefor.

3- That on every trial of any cause or appeal, the Attorney for the party in whose favor the Verdict or judgment shall be given. shall, immediately after such verdict or judgment giVen, hand up to the judge by whom the case shall he tried. a blank ﬂat, in the form following. to be filled up by the Judge with such fee as he shall deem proper :—
