The legal Juminary of the Patriot con tends that the Government Railways Act must be read with the Act of Jast session» wod then proceeds to quote from Seetion 5 vf the Government Railway Act of 1886,

“(m) Change the location of the line of railway in any particular part at any time, for the purpose of Jes-ening a curve, re- ducinga gradient, or otherwise benefiting such line of railway, or for avy other pur- pose of public advantage, &c., &c.”

All we have to say regarding this sec- tion isthat, in our opinion, it has no re- ference to locating a new railway éuch as the Murray Harbor Road, It is merely a power given to the Minister to provide for the improvement of existing lines. We go further and say that even if the sub section we have qaoted was intended to have a gen2ral application to the location of new lines, the special provision in tte act of iast session which declares that the location of the Murray Haibor Ra'lway shall be determined by the Governor in Council must prevail. When the organ gays: “‘Iltis the first time we have ever heard of a line of railway being located by Order in Council” it compl-tely sur- renders the whole position and admits that no part of tbe Murray Harbor Railway has yet been legally located.

Apparently conscious that the law is against it,the organ goes on to plead its case on other grounds; ani here is what it says:

“There is no dispute whatever abou: the location of ‘the first ten miles,’ therefore the Government has nothing to do but to accept the site fixed by the

engineers of the Minister of Railways. This is how, as a matter of course, it is

done in every case where there is no diepute, apd no doubt has been donein this case. When

two linee have been surveyed ard it is necessary to decide which shall be chosen, the Government sball in such cases deters mine the route; and the Engineers shall ‘set outand acertain such parts of the lands as are necessary and proper’ and shall make surveys, etc , for fixing the site of the railway.”

Unfortenately for the Patriow’s rea- soning, the state of things which it as- | fumes regarding the first ten miles is the very opposite of the fact. Loop lines covering art of this sectioa were describ- edon the plans prepared by the Minister ef Raiiways and ehown tothe members of Parliament daring last session. One of these started at Mutch’s point; the others at Southport. We do not think the existence or absence ofa dispute makes aoy difference.
