Roger Clarence MacLean, 22- year—old resident of Orwell, ap- peared in Supreme Court yes- terday charged with murder.

The chunky youth displayed no v1s1b1e emotions in the prison- ers box, either during the read- ing of the charge or at any point In the day-long session.

MacLean is charged with the July 26th death of his step- father, Walter Ross, age 52, of Orwell. The case is the first of three that will appear during the October sittings of the Queen’s County Supreme Court.

He referred especially to two sections of the Criminal Code of Canada; Sections 194 and 201, dealing with homicide and cul- pable offences.

He said that it was these par- ticular sections of the Criminal COIde that the jury will be call- ed‘ulpon to base their final de- cls1on. - ’ EVIDENCE LENGTHY . It was further noted that the evidence, due to the introduc- tion of exhibits, may be lengthy in spots. ,

Mr. Nicholson told the empan- elled 12-man jury that they will be given a complete picture of the incident which took the life of 52-year old Walter Ross of Orwell, stepfather of the ac~ cused. ,

Dr. MacDonald told the court that he had known Ross before his death. He was in fact the family doctor.

After receiving a call to go to the MacLean residence short- ly before 2 p.m., Dr. MacDon- ald said that he arrived only to find that Ross was dead. He noted that death could not have taken place too long before his arrival due to the warmth of the body.

He went on to state that he did not give the body a good through check but noted the congealed blood in Ross’s mouth and that the heart was not beat- mg.

Dr. MacDonald went on to say that he immediately con- tacted the coroner and R.C.M.P. officers in the area and left the house to direct the police otlficers to the MacLean home. Present at the time the doctor arrived were Mrs. Ross, wife of the dead man and mother of the accused, Mr. Wood, a neigh~ bor, and KennethaMacLean, the accused’s brother.

CROSS EXAMINATION

In the cross examination of Dr. MacDonald, defence counsel J. 0. C. Campbell, Q.C., refer- red to a Haematoma (blood un- der the skin) on the left side of the head and asked if it could have been caused by a blow on the other side. The answer was ..no.._

Dr. MacDonald further stated that persons do not normally die from black eyes, broken jaws or blows on the face.

It was noted by the defence counsel that this was not the first time that Ross had appear- ed in this shape, a statement that was backed up by Dr. Mac- Donald who said that Ross had come into his office about three years ago after taking a bad beating. He suffered three brok— en ribs on that occasion.

When asked if he had formed a conclusion at the time whether Ross was drinking or not, the doctor replied that the injured man had come in on a Monday and told him that the incident had taken place on the previous Saturday night.

Dr. MacDonald said that the

only information he had been ‘ able to gather on circumstances

surrounding the Ross death is what was told to him by Mrs. Ross during the time he spent in the house. He added that he did not pursue any further in- formation.
