The whole thing has been dash- e_d ofi with such singular efi'rontery—sncli' a bold assump- tion ofright—tbat the (would-be) leaders ofthe people seem to have .been dumbfounded by the imposing tone of their antagonists.

Although, by the course adopted by the majority, they have gained their Object—the preservaiiou of' certain seats, which had been rendered insecure by a previous blunder; yet, in pursuing that course, they appear to me to have com- iiiittedn (iii-greater, as it is one ofa deliberate character, and for which they must, to all time, be held responsible.

I‘be House of Assembly is said to be the interpreter ofits own Acts; but if. in the exercise of this privilege, it ventures upon_a line of conduct offensive to truth and justice, it will vei‘vjustly suffer in public opinion.

Party spirit sometimes induces men to trifle with princi- ples which, if suffered to be trampled upon, may result in consequences too grave and important to the state to be passed by without observation. Indeed, the first departure porn a strictly upright and direct course should be marked by our (lisapprolnition, lest it should be indexed as a prece- dent, and be used as an introduction to other evil encroach—I iiieuts.

It is now acknowledged that ntthe meeting of the House of Assembly three Gentlemen took- their seats who had no- toriously forfeited them by acceptance ofofiices ofemolu-

teased by themselves, and also by those who helped to main- tain them iii the possession of their forfeited seats for the time, that they never entertained adoubt oftlieii‘ having vacated them.

Ithiiik it must be plain to every man’s understanding, that the first business of the House, and the first ditty of the Speaker, was to ascertain that the House was rightly and legally constituted; because, il'illegnlly, then its proceedings must become of very doubtful authority. This was not done; and the consequence has been, that three Gciitlcmcu who, by a vote ol'tlie House, have since been declared to have accepted offices ofenioluninnt. disqualifying iliciii li'oui sit- ting and Vtilillg‘ in the llonse iiiitii re-elcctotl, have sat and voted, notwithstanding their tlisqiuilifiration, without refer— ence to their several constituencies, as the Act requires.

It'it was right to keep them in the House until a trouble- some question had been conveniently disposed of, there could be no justice in dismissing them afterwards. Nothing occurred between the time of their vote upon this ques- tion, and the vote oftlicir extrusion, to alter their position with regard to their constituents, and this manifest incon- sistency is abundant proof'ofthe impropriety of'the whole proceeding.
