PARIS, Dec. 29- (AP) - Great Britain and France will make a second representation to Berlin if Chancellor Hitler evades answer to the pending request to ban "volun- teer enllstments" to Fascist Spain, French Foreign Office circles said tonight. _

Asked what France would do if such representation proved barren, one official said:

"First of all we expect Germany to accept. “But in case Hitler should re- fuse, there is nothing we could do but see that all volunteers neces- sary were sent to aid the Madrid Government to balance the Ger- man aid. “We cannot watch the constitu- tion of a veritable German army on the ‘other side of our Pyrenees frontier without meeting the threat." Circles close to the Foreign Of- fice expressed fear Hitler's delay in answering the note, delivered r Sunday but made known last week, may be because of an effort to make a separate "deal" with Brit- nrn~thus isolating fiance.

These circles said there were "mysterious rumors" that Hitler had approached Britain in an at- tempt to come to terms regarding their mutual interests in Spain— such as mln€S—Wii.h, the promise that British rights would be re- spected.

Diplomatic circles revealed semi- oflfcial reports from Berlin which outlined the Nazi Government's probable answer to the Franco- British demand that foreign vol- unteer eniistments to Fascist Spain be stopped.

The reply was expected to recall the question of cutting oiI volun- teers had been proposed by Hitler, consequently there was no reason to doubt his desire to find a solu- tion.

It was said the Reich will de- clare itself ready to join Britain and France on condition they pro- mise to oppose Communism any- where in Spain.

Germany also will ask, it was predicted, that the International Brigade be retired by the Spanish Socialist Government as well as all other foreign groups fighting with the Madrid-Valencia army.

TACOMA, Wash., Dec. 29 - A special delivery letter and a prowl- er’s ladder were the only outward signs of progress tonight in solving the kidnapping of IO-ycar-old Charles Mattson, abducted Sunday night from his parents'_pretentious home.

Federal and state manhunters stayed their activities as a safety precaution while the boy's family awaited contact signal.

Police disclosed they had seized the ladder nearly two monthg ago at the mansion of George Frank- lin. Sr., after a bearded, pistol- flourishing invader had been frigh- tened away from the place on two occasions.
