Chancellor upon proof thereof, by affidavit, to make and order that such witness or witness. es shall be examined before a Master, and the evidence so taken before a Master shall be received as legal evidence, saving all just exceptions: Provided also that the Party re- quiring such examination, shall serve the Soli- citor or Solicitors of the other party or par- ies to either Suit, at least six days previously to the examination with the name and address of the Witness or witnesses: Provided never- theless that if such witness or witnesses shall at the time of the trial of the cause be on this Island and able to travel,he or they shall be re- quired to give their testimony viva voce at such trial in the same manner as if such witness or Wit- nesses had not been examined before a Master: Provided also, that allbenefit of exception to the credit of witnesses so examined before a Master, shall be reserved in the same manner as.on producing witnesses for examination viva voce at the trial: provided always, that nothing herein contained shall abridge, alter, or vary the power of the Court of Chancery, to per- petuate testimony ; provided also, that in case the Master of the Rolls, Vice Chancellor or Chancellor, shall in any case, suit, or matter pending before any or either of them, deem it advisable or expedient upon the application of any of the parties thereto, to direct the exam- ination of any witness to take place before a Master, either upon written interrogatories, or viva voce questions suggested at the time of such examination, they shall have power in either of their absolute discreLion, to order such examination before a Master,‘in such Way and manner as to any or either of them shall seem expedient, and as the justice of the case may require; and all of which said examinations, and the mode of conducting the same, and all matters connected therewith, shall be governed by such rules and regulations as shall be con- tained in the Consolidated Orders, 1869, and

such other rules and regulations, as shall from time to time, be made by the said Court, as aforesaid. .

XX. All the officers of the Court of Chan- cery shall be the officers of the Rolls'Court and Vice Chancellor’s Court respectively, and all appointments to any office in the Court of Chancery shall be made by the Chancellor with the advice and concurrence of the Master of the Rolls and Vice Chancellor.

XXI. All petitions for injunctions and motions to have injunctions dissolved, shall be supported or Opposed by affidavits as heretofore, except in such cases when the Master of the Rolls, Vice Chancellor, or Chancellor shall order and direct witnesses to be examined viva voce, and any or either of them shall have power in case the justice of the case may seem to require it to permit the party applying to dissolve an injunction, or showing cause against any motion to dissolve the same to pro- duce additional affidavits or additional evidence to contradict or explain any affidavit or evi- dence produced by the opposite party.

XXII. There shall be paid to the person who shall hold or be appointed to the office of Vice Chancellor, or assistant Judge of the Supreme Court under this Act, the sum of Five hundred pounds annually as the salary of the office, to be paid quarterly by Warrants drawn by the Liens tenant Governor upon the Treasury of this Island.
