‘WINDSOR, Conn., July 5. — Grattan Bars. a Canadian horse owned by Fred Thrown, won the $25,000 New England Pacing Derby here yesterday afternoon from a brilliant field of 2.11 pacers. Grat- tan was forced to pace an extra heat to win as the first three heats were split.

The race was one of the most spectacular seen in the history of the Bay State Circuit and a record crowd turned out.

I passed to the north oi Mac- Kinnon's car, which was to thc south oi the roadway at the C. A. A. grounds. MacKinnon would be standing between me and the right rear wheel. I didn't notice the wheel.

MacKinncn was not pointed out to me as the prisoner in the court below. I recognized him as the man I had seen at the. C. A. A. grounds.

James MacEachern Sworn) to Mr. Campbell. testified that he was tho manager of the Charlottetown Oar- age, fronting on Prince Street at the corner of Prince and Clarke Streets, and went on to tell of a car coming up on the day of the ac- cident to have some air put in the tire. It was driven by MncKinnon. This would be between a quarter to one and one thirty. The tire would not hold air, so he told MucKinnon he could do nothing for him. Mac- Kinnon then said, "I'll have to go
