or Sailing Ship, and whether foreign or other- wise, shall, while at anchor in any harbor, road- stead or fairway in this Island, exhibit between sunset and sun rise,‘where it can be best seen, but at a height not exceeding twenty feet above the hull, a White Light, in a globular lantern of; eight inches in diameter, and so constructed as to shew a clear, uniform, and unbroken light,; visible all round the horizon, and at a distance' of at least one mile.

II. If in any case of collision, it shall appear to the Court, before which the case is tried, that such collision was occasioned by the non—ob- servance of the above rule, the owner of the Ship or Vessel by which such rule has been in- fringed shall not be entitled to recover any recompense whatever for any damage sustain- ed by such Ship or Vessel in such collision ; and if any damage is sustained by any other Ship or Vessel, the owner of such Ship or Vessel in- fringing such rule shall make such recompense as shall be awarded by the Court before which the case is tried.

III. In cases of collision where the damages claimed shall not exceed Twenty pounds, the same may be tried and recovered if in the country, before any two Justices of the Peace, in the same way and manner as actions of tres- pass are triable ; and if in Charlottetown, before the Police Court thereof, and the amount of the judgment given may be levied by distress upon the tackle, apparel and furniture of the vessel against which the decision shall have been given; and if the owner or owners be absent from the Island, or not within twenty miles of the place where the collision or accident may happen, the Master, or in his absence the Chief Mate of such vessel or vessels, may be summoned in the place of such owner or owners or master.

IV._The said recited Act of the Twenty- ninth Victoria, Chapter six, and the Act of the Twenty-eighth Victoria, Chapter Two, in- tituled “ An Act to compel Masters of Vessels to exhibit a light while‘in Harbor in the night time,” shall be and the same are hereby sever- ally repealed.

PUBLIC NOTICE.

HEREAS a Commission has been issued, directed to us,

under and by virtue of an Act passed in the fourteenth year of the reign of Her present Majesty Queen Victoria, intituled ” An Act to regulate the laying out and altering of Highways," and of the Acts in amendment thereof, whereby we are commanded to estimate the damage or advantage that will accrue to the parties throngh whose land a. new line of Road is intended to pass, leading from the School House, On Black River Road, through John Flynn’s farm—along the southern boundary of James Dougan’e farm—and to the Mill- cove Road :

Now, we do hereby give public notice to all parties con. cerned, that we will commence the execution of the said Commission by attending on the said line of Road, at or near Patrick Bearney’s, on MONDAY, the 19th day of AUGUST next, at the hour of 10 o’clock, in the forenoon of the same day, and proceed in accordance with the terms of the Act 14th Vic., Cap. 1, and of the Acts in amendment thereof.

WHEREAS it Writ has been issued, directed to the under- signed, under and by virtue of an Act passed in the Fourteenth year of the reign of Her present Majesty Queen Victoria, intituled “ An Act to regulate the laying out and altering of Highways,” and of the Acts in amendment thereof, whereby we are commanded to assess the damage or advantage that will accrue to those persons who are interested in the land through which a certain new road is intended to be made, commencing at the Main Shore Road, Kildare Capes, on the line between Geo. McRae’s and William Clarke’s,and running Westward, and which road will run through or over the pro- perty of the said George Mcltae and William Clarke :

Now, we do hereby give public notice to all parties, that we will commence the execution of said Writ, on TUESDAY, the 20th day of AUGUST, at or near the House of Geo. McRae, Lot 2, at the hour of nine o’clock in the forenoon of the same day, and from thence we will proceed along the said intended new line of road and complete the inquest according to law.
