Letter From the Attorney-General.
Sin,—In your issue of yesterday you publish some remarks as to a prosecution for perjury brought against Alexanaét S. McPhee and E J. Lamont by A. C. Shaw before Mr. Mellish, J. P., and you broad!y hint that in some way 1 have im- properly used my position as Attorney- General to preveut said prosecution from being proceeded with. I am alwsya careful to avoid anything like newspaper contro- versy as to matters which affect the pros- ecution of crime, feeling strong'y that such matters should be left for the decision of the proper court, uniufluenced by the re- marks of newspaper scribblers, who very often are not fully cognizint of the real facta.
It is suggested by your paper that McPhee is my client, and therefore I have pursued the course described by you. In answer I most distinctly say McPhee is not my client. McPhee was prosecuted for taking oysters out of season and in that prosecution, which was curried on by the Dominion Government, my firm defended him; but there the relation of client ceased. Sometime afterwards, he produced to me evidence which induced me tu think that Shaw should be prosecuted for perjury. The prosecution was brought with the result that Shaw was committed for trial. His guilt or innocence wil! be decided by the proper tribunal, A few days ago the defendant, Shaw, laid an information before Mr. Mellish, a J. P. for Queen’s County, charging McPhee, the prosecutor in the per- jury case already pending, and Lamont, a witness in the same case, with perjury in the investigation before the Stipendiary Magiz- trate against Shaw. Both the Magistrate, Mellish, and the prosecutor, Mcl hee, appealed to me as Attorney-General to advise what ovght to be dene. I tcld Mr. Meilish that he had no jurisdiction, and McPhee that he need not appear. Both parties took my advice. The Magistrate, Meilish, did not attempt to act in the only way he could if he had jurise diction, namely, by issuing warrants, and the defendants did not appear on the summons. I most certainly say that it would be absurd to allow a prosecution now pending to be choked off by labeaias prosecutions for per- jury against the witneeses who are to be called in the parr case and are yet subject to examination, sm surprised that your paper should be party to any attempt to prejudice the trial of a case which is shortly to be tried. Reidiug between the lines, one can easily see that you wish the public to believe that I am prosecuting for poli ical purposes, while at the same time you must be well aware that such is not the case. To the legal liyghieweight who haa inspired your article [ would say that, not ouly is it mot clear that Mr. Meilish had authority to hear the case ia question, but the very opposite is perfectly chav. If Mr. Mell ish had jusisdiction aud wapted to act, why did he not issue his warrant avd thus test the matter. It is also perfec'ly clear that there wes no obj-ction to Mr. Shaw bringing his prcee-ution betore the Stipendiary Mayistrate, who w.s (he proper and unly person wo enters tain the case.
