A large and intelligent audience greeted Judge Alley this morning when he took his place on the County Court bench.

The first decision rendered by him was in favor of the defendant in a case brought by David Cavanegh against M. P. Hogan, in which His U nor c wplimented Me. Blanchard, the defendant’s counsel, for the able manner in which he presented his clieut’s case.

The vext case was the one of Joy against Hedley V. Palmer, Clerk of the City Court, Peter Bradley and Thomas Taylor, two pelicemen, and Mr. D. A. Bruce, merchant tailor,the plaintiff in a suit in the Ciry Court; “This was the case that ‘‘drew the crowd.” -His Honor read a very lengthy and elaborate decision, re- viewingthe whole facts, and after applying his view of the law, gave judgment in favor Of plaifitiff'against all the defendants for Bg ng ang bein the value as found by the Judye of the goods seized, includ- ing teu dollars for the one bour’s ime prisonment Ourspac: {to-day will not permit us to give an extended report of His Honor’s decision, which we would like to do, and can ouly add a summary of the finding.

1. Judge Alley sustains the contention of the plaintiff's counse! that the execution issued by the clerk of the court was abso- lutely void, and rendered all the parties responsibie for the damages.

2. The Jucge held (a point which was rendered necessary to decide owing to the line of defence adopted by the defendants) that Mr.° Fitzgerald, being Stipendiary Magistrate, was ineligible to be appuinted Judge of the City Court.

3. Whether or not the L»cal Government had the power to appoint’him, their right tu do so was prohibited by the 143rd_ sec- tion of the City Act, aad the minute of Council upon which no commission was ever issued or acted upon was of no avail ia the face of the prohibitive words of that section;* but His Honor expressed a strong opinion that the appointing power of all judges was vested in the Governor-General of Canada.

There were other questions in the case which rendered it doubtful whether the defendants could (even if above points were decided otherwise) succeed in their defence, but these, His Honor said,were unnecessary

to. deeide. Regarding Mr. Fitz- gerald’s, position as Judge of the City Court, Judge Alley said tlat

the evidence produced by the defend- ants’ counsel! expressiy raised the question, and it therefore became his duy as a Judge to decide it. This was required, not only in the ittterests of the parties to this suit, but in the interests af all parties who have brought actions in the City Court, and

who might endeavour to euforce their judgment. These parties, should it be found that the, ‘court was not properly

constituted, would not only lose their debts but be mulcted in heavy damages for en- forcing processes of a court without juris diction Hence the necessity in the interests of all, to decide the points raised by the defence,

Question of the Site.

Srm,—As the hotel schem3 is now about maturing into a definite certainty, it is to be hoped it will not be wrecked in a squab- ble over a site, as was the case with a sim- ilar proposal some three years ago. The site for such a building is of vital i:aport- ance to its future success and should be very carefully considered.

**Fairholm,” of course, isa fiae property and a first-class hotel on this sice would be a pleasant object to iook at for the peuple living in the vicinity or passing up and down the streeis, But as the pecple wewish to induce to come tothe Isla.d and re- main in Charlottetown, and will live in the hotel and have to look cut of the windows, we should consider the site altogether from iheir standpoint. Now, those people will probably be from American or Canadian cities, who are tired of the dust snd _ heat of city surroundings, and who would thor- oughly enjoy an cutlook over the wa er, snd_the suggestive pleasautness cf distant hills and fields.

li stwikes me that it would be fiaaucial madness to place these people in a hotel at Fairholm or avy other site in the interior of the town, where they would have dingy, unpainted and monstrously ugly buildings snd muddy s:reets to look at, and dusty air « breatbe,.and from the upper windows an xpanse of biack roofs and smoky chimneys before their eyes. Instead of staying in che town, they would all hurry away as soon as possible.

The view towards the West River hills in morning, noon or evening, varies with.every change of light or movement o: stmosphere, and to all strangers is enchant og. The shore immediately beluw th property is a sandy one, instead of being thuddy, aS is generally supposed, and at the lowest tide, with a westerly wind, no bad Gdor i$ ever experienced The hotel on this site would be noticed as an attract- ive feature by ail steamers entering the harber, and the building would be large enough to give character to all the streets urrownding it, and a little expenditure is

Along he Esplanade would be the entrance to it from railway and steamer and from Victoria Park and Brighton along West Street. Che air would. always be tresh, pure and clear of dust and at a lower temperature than in the centre of the town.

If auxiliary summer hotels are «rected at Keppoch and Holland Cove the hotel on this sie would be only a few miles distance by steam launch from them. From the hotel to Cardiff's sand beech, where bathing may be indulged ia at dead low water, the distance is but one mile anda quarter (only a few mio ates in a launch), while both of the hotels on he north shore are three qtar-ers of a mile wer sandhills from the bat:i g h uses.

From the hotel on Douse’s site, easy access st all times could be had to the mckerel fish- ieg, form of sport that the Americans are very fond of. Avsteam launch could make continuous round trips from the hotel whart to Keppoch, the block house, Rocky Point wharf and North Point, and thus afford the guests many varied rambles in the country and about the shores.
